Fermigo Terms of Service

Please read these Terms of Service carefully before using Fermigo.

These Terms explain the rules for using the Fermigo website, Android app, games, activities, content, and related services. By accessing or using Fermigo, you agree to these Terms.

If you do not agree to these Terms, please do not use Fermigo.

1. About Fermigo

Fermigo is a playful learning app for children, designed to help them build critical thinking skills through short games, puzzles, estimation challenges, logic activities, and offline prompts.

Fermigo is designed for families. Children may use the app, but the parent or legal guardian is responsible for approving, supervising, and managing the child’s use of Fermigo.

For the moment, Fermigo is available through Google Play for Android devices.

2. Who can use Fermigo

Fermigo may be used by children only with the permission and supervision of a parent or legal guardian.

By using Fermigo, you confirm that:

• you are at least 18 years old or the age of legal majority in your country; or
• you are a parent or legal guardian accepting these Terms on behalf of a child; or
• you are using Fermigo with the permission of your parent or legal guardian.

Parents and guardians are responsible for:

• deciding whether Fermigo is appropriate for their child;
• supervising the child’s use of the app;
• managing purchases, subscriptions, and device permissions;
• ensuring that the child uses Fermigo safely and responsibly.

3. Parent responsibility

Fermigo is designed to be child-friendly, but it is not a replacement for parental supervision.

Parents and guardians are responsible for the child’s use of Fermigo, including:

• the amount of time the child spends using the app;
• whether the child completes suggested offline challenges;
• whether the child uses the app in a safe environment;
• any purchases or subscriptions made through Google Play;
• compliance with these Terms.

Fermigo may suggest offline activities, such as observation games, estimation challenges, or conversation prompts. These activities should be completed safely and with appropriate adult supervision when needed.

4. Use of Fermigo

You may use Fermigo for personal, family, and non-commercial purposes only.

You agree that you and any child using Fermigo under your supervision will not:

• use Fermigo for illegal, harmful, abusive, or fraudulent purposes;
• try to hack, copy, modify, reverse engineer, or interfere with the app or website;
• use bots, scrapers, automation tools, cheats, exploits, or unauthorized software;
• overload, disrupt, or damage Fermigo’s systems;
• attempt to access data, accounts, systems, or content that you are not allowed to access;
• use Fermigo to collect information about other users;
• upload, send, or share harmful, offensive, illegal, or infringing content;
• use Fermigo commercially without our written permission;
• copy, resell, distribute, or exploit Fermigo’s games, content, designs, characters, or materials.

We may suspend or stop access to Fermigo if we believe these Terms have been violated or if we need to protect the app, our users, or our systems.

5. Accounts and access

Fermigo may allow parents or guardians to create an account, manage a child profile, access a parent area, or use app settings.

You are responsible for keeping your account information secure.

You agree to provide accurate information when creating or managing an account. You are responsible for activity that happens through your account, device, or subscription.

6. Purchases and subscriptions

Fermigo may offer free content, paid content, subscriptions, in-app purchases, or promotional access.

All purchases and subscriptions made through the Android app are handled by Google Play.

This means that:

• payment processing is handled by Google Play;
• subscriptions are managed through your Google Play account;
• cancellations are handled through Google Play;
• refunds are generally handled according to Google Play’s refund policies;
• deleting the app does not automatically cancel a subscription.

Please review your Google Play account settings to manage or cancel a subscription.

Fermigo does not directly collect or store your full payment card information.

We may receive limited purchase or subscription information from Google Play, such as purchase status, subscription status, transaction identifiers, or access entitlement information, so that we can provide paid features.

7. Free trials and promotions

Fermigo may offer free trials, discounts, promotional codes, or limited-time offers.

The specific terms of each promotion will be shown at the time of the offer.

Unless stated otherwise:

• promotions are for personal use only;
• promotions cannot be exchanged for cash;
• promotions may be changed or withdrawn where allowed by law;
• after a free trial, a subscription may automatically renew unless cancelled before the trial ends.

Please check the offer details in Google Play before confirming a subscription or purchase.

8. Changes to pricing or features

We may change Fermigo’s features, pricing, subscriptions, games, content, or availability from time to time.

If a paid subscription price changes, the change will be handled according to Google Play’s applicable rules and notice requirements.

We may add, update, remove, pause, or discontinue parts of Fermigo at any time. We will try to make changes in a fair and reasonable way, especially where they affect paid access.

9. Intellectual property

Fermigo, including its name, logo, characters, mascot, games, designs, illustrations, text, sounds, animations, software, code, game mechanics, activities, website content, and other materials, belongs to Fermigo or its licensors.

You may not copy, modify, distribute, sell, license, reproduce, publish, or create derivative works from Fermigo content without our written permission.

You may use Fermigo only as allowed by these Terms.

Nothing in these Terms gives you ownership of Fermigo or any Fermigo content.

10. Personal and non-commercial use

Fermigo is provided for personal and family use.

You may not use Fermigo for commercial purposes without our written permission. This includes using Fermigo content, games, screenshots, characters, activities, or downloadable materials in a paid product, course, classroom product, app, book, social media product, training, or commercial service.

Teachers, therapists, schools, or organizations who want to use Fermigo in a professional or institutional setting should contact us first at: contact@fermigokids.com

11. Downloadable materials

Fermigo may provide printable activities, worksheets, PDFs, guides, or other downloadable materials.

Unless we clearly say otherwise, downloadable materials are provided for personal, family, and non-commercial use only.

You may not:

• resell them;
• upload them to marketplaces;
• claim them as your own;
• remove copyright notices;
• distribute them as part of another product;
• use them in commercial programs without permission.

All downloadable materials are provided “as is” and should be used with appropriate adult judgment.

12. Feedback and suggestions

We welcome feedback, ideas, comments, suggestions, and reviews about Fermigo.

If you send us feedback, you agree that we may use it to improve Fermigo without owing you payment or credit.

This includes ideas for:

• new games;
• app improvements;
• copy changes;
• feature suggestions;
• bug reports;
• educational improvements;
• design improvements.

Please do not send us confidential information, trade secrets, or ideas you do not want us to use.

13. User content and social media

Fermigo does not currently include open chat, public profiles, or public posting inside the app.

If you voluntarily send us content, such as comments, testimonials, screenshots, reviews, messages, or social media posts, you confirm that you have the right to share that content with us.

If you tag Fermigo on social media or send us content that includes a child’s image, name, voice, or other personal information, you confirm that you are the child’s parent or legal guardian, or that you have permission from the child’s parent or legal guardian.

We will not intentionally use a child’s image, name, or personal information in marketing without appropriate permission.

14. Privacy

Your privacy and children’s privacy are important to us.

By using Fermigo, you also agree to the practices described in our Privacy Policy.

15. Third-party services and links

Fermigo may include links to third-party websites, services, app stores, payment providers, or resources.

These third-party services are not controlled by Fermigo. We are not responsible for their content, policies, availability, security, or privacy practices.

Your use of third-party services is subject to their own terms and policies.

This may include, for example:

• Google Play;
• payment processors;
• analytics or crash-reporting providers;
• customer support tools;
• external websites linked from the Fermigo website.

16. Educational purpose

Fermigo is designed to support playful learning, curiosity, and critical thinking.

However, Fermigo does not guarantee specific educational results.

Fermigo is not a school, tutoring service, psychological service, medical service, therapy tool, assessment tool, or diagnostic tool.

The content inside Fermigo is provided for general educational and entertainment purposes.

Parents and guardians are responsible for deciding whether Fermigo is suitable for their child’s age, needs, learning style, and context.

17. App availability

We work to keep Fermigo available and functioning well, but we cannot guarantee that the app or website will always be uninterrupted, error-free, secure, or available in every country, device, operating system version, or language.

Fermigo may be unavailable due to:

• maintenance;
• updates;
• technical issues;
• third-party service interruptions;
• platform restrictions;
• legal or regulatory requirements;
• changes to Google Play availability;
• events outside our control.

We may change, suspend, or discontinue parts of Fermigo at any time.

18. Updates to the app

We may release updates to Fermigo to improve performance, add features, fix bugs, improve safety, or comply with platform or legal requirements.

Some updates may be required for Fermigo to continue working properly.

If you do not install updates, some parts of the app may not work as expected.

19. Security

We take reasonable steps to protect Fermigo and the information processed through the app or website.

However, no digital service is completely secure.

You are responsible for:

• keeping your device secure;
• using trusted app stores;
• managing Google Play account access;
• supervising child use;
• keeping login information private, where applicable.

Please contact us if you believe there has been unauthorized access or a security issue.

20. Disclaimers

Fermigo is provided on an “as is” and “as available” basis.

To the maximum extent allowed by law, we do not guarantee that:

• Fermigo will always be available;
• Fermigo will be error-free;
• all content will always be accurate, complete, or up to date;
• the app will meet every child’s needs;
• the app will produce specific educational outcomes;
• the app will be compatible with every device or Android version;
• any errors or defects will always be corrected immediately.

Nothing in these Terms limits rights that you may have under consumer protection laws that cannot legally be excluded.

21. Limitation of liability

To the maximum extent allowed by law, Fermigo, its owners, team members, partners, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of Fermigo.

This includes, where legally allowed, damages related to:

• loss of data;
• loss of access;
• device issues;
• service interruptions;
• errors in content;
• subscription or payment issues handled by Google Play;
• use or inability to use the app;
• reliance on app content or suggested activities.

To the maximum extent allowed by law, our total liability for any claim related to Fermigo will not exceed the amount you paid for Fermigo in the 12 months before the claim, or EUR 50, whichever is greater.

Some countries or regions do not allow certain limitations of liability, so some of these limits may not apply to you.

22. Indemnity

To the maximum extent allowed by law, you agree to protect Fermigo from claims, losses, damages, liabilities, costs, and expenses arising from:

• your misuse of Fermigo;
• your violation of these Terms;
• your violation of applicable law;
• content or information you send to us;
• unauthorized use of your account or device;
• your infringement of another person’s rights.

This section does not apply where prohibited by law.

23. Termination

You may stop using Fermigo at any time.

We may suspend or terminate access to Fermigo if:

• you violate these Terms;
• we need to protect children, users, our team, or our systems;
• we are required to do so by law;
• we discontinue the app or a feature;
• your subscription ends, expires, is cancelled, or cannot be verified.

After termination, sections that by their nature should continue will remain in effect, including intellectual property, feedback, privacy, disclaimers, limitation of liability, indemnity, governing law, and general terms.

24. Changes to these Terms

We may update these Terms from time to time.

If we make important changes, we may notify you through the website, app, Google Play listing, email, or another reasonable method.

The “Last updated” date at the top shows when these Terms were last changed.

By continuing to use Fermigo after changes take effect, you agree to the updated Terms.

25. Governing law

These Terms are governed by and interpreted in accordance with the laws of Romania, without prejudice to any mandatory consumer protection rights that may apply under the laws of the country in which you live.

Any dispute arising out of or relating to these Terms or the use of Fermigo will be submitted to the competent courts of Romania, unless applicable consumer protection laws give you the right to bring proceedings before the courts of another country, including the courts of the country in which you are habitually resident.

Nothing in these Terms limits or excludes any rights or remedies that cannot legally be limited or excluded under applicable law.

Because Fermigo is available worldwide, some users may have mandatory local rights that these Terms cannot limit.

26. General terms

These Terms, together with our Privacy Policy and any additional terms shown inside the app or on Google Play, form the agreement between you and Fermigo.

If any part of these Terms is found to be invalid or unenforceable, the remaining parts will continue to apply.

If we do not enforce a part of these Terms immediately, that does not mean we give up the right to enforce it later.

You may not transfer your rights or obligations under these Terms without our permission.

We may transfer our rights or obligations if Fermigo is involved in a merger, acquisition, reorganization, sale of assets, or similar business change.
